SMS / Text Messaging Terms

Fugio Funding Network operates an SMS / text messaging program for business owners who request a funding plan or are otherwise engaged in a funding consultation with us. This page describes the program and the consent you give when you opt in.

The checkbox is optional and unchecked by default. Opt-in to SMS is not required to submit the form, to receive a funding plan, or to receive any service from Fugio Funding Network.

Fugio Funding Network operates a single category of SMS messages:

• Non-marketing (service) messages: Updates on your funding plan, application status, document requests, lender submission updates, appointment reminders, and account-related information tied to your funding consultation.

We do not use SMS to send marketing, promotional, or special-offer messages.

The following are representative of the SMS messages you may receive after opting in:

Message frequency varies. SMS messages are sent as needed based on your funding consultation activity — for example, status updates, document requests, lender submission updates, and appointment reminders. A typical opted-in customer receives a small number of service messages per month while their funding plan is active.

Standard message and data rates may apply according to your mobile carrier's plan. Fugio Funding Network is not responsible for any carrier charges. Contact your wireless provider for questions about your text or data plan.

Carriers are not liable for delayed or undelivered messages. SMS delivery depends on your mobile carrier and network conditions and is not guaranteed.

Fugio Funding Network sends SMS messages from a pool of dedicated business phone numbers registered to our brand. The specific number a given message is sent from may vary across the pool. Regardless of which number a message arrives from, replying STOP to that message will opt you out of all further SMS messages from our program, and replying HELP will return program information.

You can opt out at any time using any of the following methods:

• Reply STOP: Reply STOP to any SMS message you receive from us. You will receive a one-time confirmation message, after which no further SMS messages will be sent.
• Email: Send an email to team@fugiofundingnetwork.com with "UNSUBSCRIBE SMS" in the subject line and the mobile number you want removed in the body.

Opt-out requests are processed immediately upon receipt. Opting out of SMS does not affect your ability to use any other Fugio Funding Network service or to receive email communications.

You must be at least 18 years old and the authorized user of the mobile phone number you provide. By opting in, you represent that you meet these requirements and that you provide your prior express written consent to receive non-marketing text messages from Fugio Funding Network at the mobile number you submit. Consent is not a condition of receiving services.

For purposes of our SMS program, your mobile phone number and SMS opt-in consent information will not be shared with or sold to third parties, affiliates, or lead generators for marketing or promotional purposes. SMS delivery providers used to operate the program are bound by confidentiality and may only use your number to deliver and operate our SMS messages.

We retain a record of each SMS opt-in, including the verbatim consent text shown, the timestamp, the URL where consent was captured, and the mobile number to which consent applies, for a minimum of five (5) years for TCPA and A2P 10DLC compliance and audit purposes. Opt-out events are retained on an indefinite basis to prevent re-sending after a STOP request.

Our SMS messaging program is operated in accordance with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and applicable carrier requirements for A2P 10DLC messaging. These SMS Terms are part of, and are incorporated by reference into, our Terms of Service.
